CLIENT SERVICES AGREEMENT
This Agreement (the “Agreement”) is entered into among CRAFT CCC, LLC d/b/a Craft College Consulting (“CCC”), and the Client, legal guardian, or other financially responsible party (the “Client”) of the student client (the “Student”), effective as of the date of purchase of “The Work” via CCC’s website. Jane Chamberlain, the sole member of CRAFT CCC, LLC, will serve as the consultant (the “Consultant”) and provide college admissions counseling and related services (the “Work”) to the Student.
1. SCOPE OF WORK
Work: CCC agrees to provide services and materials (the “Work”) at the request of the Client for fees agreed upon in advance and to deliver the Work in the manner described under Consultant Duties and Responsibilities below. The Client and Student agree to fulfill their responsibilities as described. This Agreement aims to (1) reduce the risk of disputes by clarifying expectations and (2) make it easier to resolve any disputes that may arise.
2. COMPENSATION & PAYMENT TERMS
- Prepaid Packages
- Clients typically purchase a package of hours (the “Prepaid Hours”) in advance for Services. All time the Consultant spends in direct sessions or performing work on the Student’s behalf (e.g., research, essay editing) will be deducted from these Prepaid Hours.
- Any purchase or package details, including the total number of hours, are agreed upon at the time of purchase on CCC’s website.
- Scheduling & Deduction of Time
- The Student or Client is responsible for scheduling appointments (via the Consultant’s link or a mutually agreed method).
- Direct Meetings: The duration of each meeting (e.g., one hour) is deducted from the Prepaid Hours.
- Preparation & Follow-Up: The Consultant may also deduct time spent outside of meetings on tasks such as college list research, editing, or emailing the Student/Client, billed in increments as agreed in advance.
- Surge Periods & Extra-Time Deduction
- Certain times of year (e.g., the day after Thanksgiving, December 22–23, December 26–30, or otherwise noted) are designated as surge periods.
- Instead of charging an additional fee, the Consultant will deduct extra time from the Prepaid Hours. For example, if the surge surcharge is 20%, 1 hour of work during a surge period is 1.2 hours deducted from the Client’s remaining balance.
- The Consultant will provide notice to the Client if the Student’s tasks fall during a surge period, so the Client can decide whether to proceed or defer non-urgent work.
- Pausing Services & Banking Hours (Up to 18 Months)
- Option to Pause
- The Client may request to pause services (e.g., if the Student receives state-sponsored services or has other commitments) by providing written notice to the Consultant.
- Upon pausing, the Consultant will calculate any remaining Prepaid Hours and hold them (bank) for up to 18 months from the date of pause.
- Resuming Services
- The Client may resume services at any point within the 18-month pause period. The Consultant will apply the remaining hours toward new or ongoing services.
- If the Consultant’s base hourly rate changes during the pause, the banked hours remain at the originally purchased rate, but any additional hours needed beyond the banked amount will be at the then-current rate.
- Expiration of Banked Hours
- If the Client does not resume services within 18 months, any remaining hours expire. The Consultant is not obligated to provide further services or refunds for expired hours.
- The Consultant may, at her discretion, grant a one-time extension if the Client demonstrates extenuating circumstances (e.g., serious illness).
- Refund Instead of Pausing
- If the Client prefers a refund of unused hours instead of pausing, the Consultant will provide a prorated refund less any applicable surge fees, cancellation fees, or service fees deducted by the platform service provider.
- Once a refund is issued, the Client’s remaining hours are no longer available.
- Refunds & Service Fees
- If the Client requests a refund for unused hours (e.g., terminates this Agreement early), the Consultant will calculate any remaining balance by:
- Subtracting the value of hours already used at the Consultant’s then-current rate (including any surge multipliers if applicable).
- Less any applicable surge fees, cancellation/no-show fees, or platform service fees (e.g., Kajabi, Stripe, PayPal).
- Non-Refundable Dissatisfaction: The Client acknowledges that no refund will be given solely due to dissatisfaction with admissions, scholarship offers, or other outcomes.
3. TERM AND TERMINATION
- This Agreement shall expire on June 15th following the Student’s senior year of high school (unless extended by mutual agreement).
- Either party may terminate this Agreement at any time and for any reason with 30 days’ notice to the other.
- Pro-Rata Refund: If terminated, a prorated refund (if any) will be issued according to Section 2.5, subject to deductions for hours used, surge multipliers, and fees.
- If the Consultant becomes unable to perform Services due to serious illness, disability, or family emergency, she will:
- Notify the Student and Client promptly to discuss concerns, and
- Within 30 days, provide a written plan to transition the Student to another recommended college counselor.
- If the Consultant dies or becomes incapacitated before all Services are completed, the Client may contact the Consultant’s executor for a referral to another consultant or discuss a partial refund (per Section 2.5).
4. CONSULTANT DUTIES AND RESPONSIBILITIES
The Consultant agrees to provide Services from among those listed in Exhibit A, based on the purchased package or hours. This includes:
- Proprietary Information & Counseling: Offering tools and strategies for a college admissions plan.
- Confidentiality: Maintaining confidentiality of Client and Student information unless given written authorization or if the Student is in a life-threatening situation.
- Appointments & Rescheduling: Keeping scheduled appointments, notifying of any need to reschedule, and including the Client/family at the Consultant’s discretion.
- Reasonable Responsiveness: Generally replying to emails/texts within 3 business days (Mon–Fri) and providing essay feedback within a similar timeframe, barring Consultant vacations or prior missed deadlines by the Student.
- Balanced College List: Recommending a range of “likely,” “target,” and “reach” colleges.
Services Not Included
- Completing the Student’s applications or writing the Student’s essays
- Completing FAFSA, CSS Profile, or other financial forms (though the Consultant may share informational links)
- Requesting recommendation letters from teachers or counselors
- Setting up college visits
- Routinely chasing down the Student for scheduling
In divorced or separated parent situations, the Consultant may share information with both parents, regardless of which parent is paying.
Work Days: Monday, Wednesday, Thursday, Friday, Saturday. The Consultant does not work on major holidays (New Year’s Eve/Day, July 4th, Easter, Thanksgiving, Christmas Eve/Day). Additional vacation days or travel time will be communicated to current clients.
Consultant Disclaimers on Services
- No Guarantees: Neither CCC nor the Consultant guarantees admission to any college or the Student’s satisfaction with outcomes.
- Student Responsibility: The Student must meet deadlines, complete applications, and provide requested information; the Consultant is not liable for missed deadlines due to Student/Client delays.
- Financial Aid: The Consultant may identify potential sources of merit or need-based aid, but no guarantee is made regarding awards.
- No Influence: The Consultant will not exert any influence or accept compensation from any institution regarding the Student’s admission or financial aid package.
5. STUDENT DUTIES AND RESPONSIBILITIES
- Scheduling & Communication: The Student schedules meetings via the Consultant’s provided link and replies to Consultant emails/texts in a timely manner.
- Cancellation & No-Shows:
- A 24-hour notice is required for cancellations/rescheduling. Otherwise, the Consultant may deduct the full planned session length from the Student’s Prepaid Hours.
- Arriving more than 15 minutes late without notice may count as a “no-show,” likewise resulting in a deduction of the session from Prepaid Hours.
- Technical Requirements: For Zoom calls, the Student must have a working camera/microphone in a quiet space.
- Work Product & Plagiarism: The Student must submit their own work. Plagiarism or use of AI (e.g., ChatGPT) to generate essays is prohibited and may result in termination.
- Internal Deadlines: The Student agrees to honor any internal “soft” deadlines set by the Consultant for essay/application drafts.
- Application Logistics:
- Submitting applications on time and ordering transcripts/test scores are the Student’s responsibility.
- The Student also handles teacher recommendations and any required creative supplements or auditions.
- Post-Application Tasks: The Student must monitor each college’s portal and complete any additional requests or forms.
- Decision Notifications: The Student will notify the Consultant of any offers, acceptances, or scholarships and of their final enrollment decision.
6. CLIENT DUTIES AND RESPONSIBILITIES
- Information Provision: Supply accurate academic, personal, and financial info as needed.
- Open Mind: Be willing to consider new or alternative colleges suggested by the Consultant.
- College Visits: Assist the Student in scheduling campus tours or visits if necessary.
- Ethical Conduct: Refrain from writing the Student’s essays or interfering with the Student’s independent work.
- Financial Aid Forms: Assist the Student with FAFSA, CSS Profile, and any scholarship forms.
- Consistent Communication: Stay responsive, especially regarding deadlines.
- Proprietary Materials: Do not share CCC’s copyrighted guides, spreadsheets, or email content without authorization.
- Outcome Dissatisfaction: No refund is owed solely due to disappointment with admissions or financial aid results.
7. CONFIDENTIALITY & INTELLECTUAL PROPERTY OWNERSHIP
Each party will keep the other’s information confidential. The Consultant may share Student essays with third-party editors or proofreaders under similar confidentiality obligations.
CCC owns valuable proprietary information and copyrighted materials. The Client agrees not to disclose or misuse any of CCC’s methods, processes, or materials. Any breach could cause irreparable harm, entitling CCC to injunctive relief and damages.
8. LIMITATION OF LIABILITY
The Client agrees not to hold CCC or the Consultant liable for any denied admissions or disappointing financial aid awards. In no event will CCC or the Consultant be liable for indirect, special, incidental, or consequential damages, nor for direct damages exceeding the total Fees paid under this Agreement.
9. MARKETING PERMISSIONS
The Client and the Student (if of legal capacity) agree that CCC may use the Student’s first name or initials in testimonials. CCC may list general college acceptance outcomes without disclosing full names. CCC may request additional permission to highlight specific student accomplishments on social media.
10. DISPUTE RESOLUTION
- Governing Law: This Agreement is governed by Michigan law.
- Negotiation & Mediation: If a dispute arises, the parties will attempt good faith negotiation. Failing that, they will engage in mediation.
- Fees & Costs: The non-prevailing party in mediation or litigation shall reimburse the prevailing party for reasonable attorneys’ and/or mediator fees.
- Venue: Any lawsuit arising from this Agreement must be filed in the courts of Kent County, Michigan.
11. ACCEPTANCE OF TERMS
This Agreement, together with the purchase of “The Work” on CCC’s website, represents the entire agreement between the parties and supersedes any prior or contemporaneous agreements. It may be modified only in writing, signed by all parties.
By purchasing The Work, the Client acknowledges they have read, understood, and agree to be bound by this Agreement’s terms.

DESCRIPTION OF PACKAGES AND SERVICES
Because CCC’s college planning curriculum is customized for each student, it may include all or some of the following Services:
- Admissions Strategy
- Recommendations to enhance the high school transcript
- Exploration of extracurricular achievements, summer experiences, and career interests
- Résumé & Testing
- Guidance on creating or revising the Student’s college résumé
- Suggesting a testing strategy, timeline, and test prep resources
- College List Creation
- Collaborating to develop an initial list based on Student/Family priorities (major, affordability, location, size, etc.)
- Advising on likely, target, and reach institutions
- Identifying possible merit/financial aid opportunities
- Application & Essay Assistance
- Brainstorming essay topics, providing editorial tips, and critique
- Guidance on the Common Application or other college/unified state system applications
- Additional fees or hours may apply if the Student exceeds the number of supported applications in the chosen package
- Interview Preparation
- Practice interviews, sample questions, and feedback
- Deferrals & Waitlists
- Strategies for letters of continued interest and alternative pathways
- Choosing a College
- Decision Day support
- Weighing admissions offers and financial aid packages
- Financial Aid & Scholarships
- Advising on potential scholarship sources
- Providing best-efforts negotiation tips to maximize financial/merit awards
